***Let me preface this to say this is the actual accounting of what occurred**

In 2005 the Pizza Shop in Ashland was offered to me and my friends to purchase, and agreed to a price and the based upon documents furnished and the claims made felt this was a reasonable purchase. And we could run this from Florida. What I did not know was the hidden agenda nor the seller’s remorse or the extent which the seller would go to jeopardize the profitability and sales of the shop.

The most depressing issue was that the seller was my family, they knew how to help, the truth of the matter is was sold with every pretense to regain control even though they told me they would never go back in that business again.

My employee’s (which shall remain nameless) were some of the finest people a person could have and I will always be grateful to them., for their long suffering and their loyalty.

THE SALE:

Claims Made:

The seller made claims that the shop made 41% in profit in fact on many occasion the seller made mention of the 41% profit to myself and to that of my partners. Point of fact is we did not have an written statement to the 41% I mean why would we. The seller was family. Based upon the sellers statement we purchased the shop. Little did we know that the shop never did make 41%.

The Reality:

Let me take this a step further:

As the seller ran the shop for for the first 90 days, and with us keeping the books there was never a time when the shop ever made 41%. I mean this was the seller running the shop? It stands to reason some decline may have occurred due to the transfer of ownership however the difference between what we actually made and the 41% claimed was a vastly different.

Now it took some time for the seller to admit of the 41% in writing but they did finally and I hold that on file here in Florida as well as on the actual server hard-drive taken from the actual online server in Houston Texas.

Could this be a circumstance of fraud by the seller, or the conversion of  funds from myself and partners to the seller. I do not know the the sellers motivation, but I do know it happened. To date the seller has shown absolutely no remorse whatsoever.  In fact the the seller has not spoken with myself, my wife, her (the seller’s) own grandchildren. That’s heart breaking to the grand children.. above all the children did nothing wrong!
